This Terms of Service and Privacy Policy Agreement (“Agreement”) governs your access to and use of Focus CRM (the “Service”), operated by:

By accessing or using the Service, you agree to this Agreement. If you do not agree, do not use the Service.
Focus CRM is a cloud-based customer relationship management software platform that allows users to manage contacts, companies, tasks, notes, and related operational business data.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time without liability.
You must be at least 18 years old and legally capable of entering binding agreements to use this Service.
The Service is intended for business use only.
You agree to:
We are not responsible for losses caused by unauthorized account use.
You retain full ownership of all data uploaded or entered into the Service (“Customer Data”). Focus CRM does not claim ownership of Customer Data.
We do not sell, rent, trade, or monetize your Customer Data.
For purposes of applicable data protection laws:
We process Customer Data only to provide and maintain the Service, provide technical support, ensure system security, and comply with legal obligations. We do not access your data except as necessary to provide the Service or comply with law.
We use information to provide and maintain the Service, improve functionality, send service-related communications, and send product updates and marketing communications from Focus CRM.
We do not sell personal information.
We process personal data under contractual necessity, legitimate interests, legal obligations, and consent where required.
You have the right to access, correct, delete, restrict, object to processing, and request portability of your data, and to withdraw consent. Contact trevor@focusai.us. We will respond in accordance with applicable law.
Where data is transferred outside the EU, we rely on appropriate safeguards including contractual protections consistent with Standard Contractual Clauses.
If you are a California resident, you have the right to know what personal information we collect, know whether it is sold or disclosed, request deletion, and opt out of sale.
Focus CRM does not sell personal information.
To submit a request, contact trevor@focusai.us. We will not discriminate against users for exercising privacy rights.
We may send product updates, feature announcements, service-related notices, and marketing communications from Focus CRM. You may opt out of marketing communications at any time.
We do not sell or share user email addresses for third-party advertising.
We implement reasonable administrative, technical, and organizational safeguards to protect information. No method of transmission over the internet is completely secure. You acknowledge and accept the inherent risks of internet data transmission. We are not liable for breaches beyond our reasonable control.
We retain data while your account is active, as required for legal compliance, and as necessary for legitimate business purposes. Upon termination, we may delete Customer Data after a reasonable period.
You may not:
We may suspend or terminate accounts for violations.
We may use third-party service providers including cloud hosting providers, payment processors, and infrastructure vendors. These providers are contractually obligated to maintain confidentiality and security. We are not responsible for third-party outages.
The Service is provided “as available.” We do not guarantee uninterrupted service and are not liable for downtime, data loss, or service interruptions.
The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee business results, revenue growth, or operational outcomes.
To the maximum extent permitted by law, Focus CRM shall not be liable for indirect damages, consequential damages, lost profits, business interruption, data loss, or special or punitive damages.
Our total liability shall not exceed the greater of $100 USD or the total amount paid by you in the 12 months preceding the claim. If you use the free version of the Service, liability is capped at $100 USD.
You agree to indemnify and hold harmless Trevor Hunter and Focus CRM from claims arising out of your misuse of the Service, your uploaded data, your violation of applicable laws, or your violation of this Agreement.
All software, branding, and materials are owned by Focus CRM. You may not copy, distribute, or reproduce any part of the Service without written permission.
We may suspend or terminate accounts for violation of these Terms, illegal activity, or non-payment. Upon termination, access to the Service may be revoked.
This Agreement is governed by the laws of the State of North Carolina, United States. All disputes shall be resolved in the courts located in North Carolina unless arbitration is elected.
At our election, disputes may be resolved through binding arbitration in North Carolina instead of court proceedings. By using the Service, you waive the right to participate in class-action lawsuits.
We may update this Agreement at any time. Continued use of the Service constitutes acceptance of updated terms.
